INSTRUCTIONS
You are the "Plaintiff". The person/business you are suing is the "Defendant." You may sue for recovery of money only.
In order to file a small claim with North Las Vegas Justice Court, the Defendant must either reside, work, or operate a business in the North Las Vegas Township at the time of filing the small claim.
North Las Vegas Township includes all of the City of North Las Vegas and the unincorporated area of Clark County east of Decatur Boulevard, north and west of Las Vegas Boulevard, and north of Lone Mountain Road.
If it is a business you are suing, you must have the name of the owner or resident agent. If it is a corporation, you must have at least one name of the corporate officers or resident agent. If you do not have that information, you may obtain if from the License Bureau where the business is located. If the business is in the City of North Las Vegas, call the License Bureau, at (702) 633-1520 or (702)633-1521; if the business is in Clark County, call Clark County Business License, at (702) 455-4252.
The Court only renders a judgment, before you file, investigate to see if you can collect in the event you should receive a judgment. You should provide information such as where the Defendant works or banks, or list property that you might attach in order to collect your judgment.
Filing Fees (Must be Paid in Advance)
$43.00 - Claims up to $1,000.00
$63.00 - Claims $1,000.01 to $2,500.00
$83.00 - Claims $2,500.01 to $5,000.00
Service Fees (Must be Paid in Advance)
The North Las Vegas Constable's Office will serve the small claim for you,
if you require it at $17.00 per person plus $2.00 per mile.
A tentative Court date will be set at the time of filing the small claim (usually 8 - 10 weeks in advance on a Wednesday). The Defendant must be served at least 10 days prior to this scheduled Court date. You must verify with the Court one (1) day prior to your tentative scheduled Court date to assure your case is on the calendar. If it is not on for the scheduled date, verify with the Constable's Office for the served date.
You must prove in Court:
1. That the Defendant is indebted to you in the amount of your claim.
2. That you have made demand for payment (sent a demand letter to the Defendant by certified, return receipt mail and allow 10 days for a response before filing. If there is no satisfactory reply, bring in the post office receipt or other proof and file the small claim).
3. That the Defendant has refused or failed to pay.

The above forms must be typed or written legibly in blue or black ink, A case number and court date will be given at the time of filing.
Acceptable forms of payment on civil cases are:
Cash, Cashier's Check, Money Order, Business Check, ATM Debit Card, Credit Card (VISA or Mastercard only)
If filing by U.S. Mail, please use a 9" x 12" envelope for mailing. You are also required to include a self addressed stamped legal size envelope so that we can return your receipts and filed documents to you.

IMPORTANT NOTE:
North Las Vegas Justice Court does not provide a court reporter for civil cases. If you want a court reporter to be present for your hearing, you will need to make arrangements a minimum of seven (7) days prior to your court date. If your case is assigned to Department 1, Judge Dahl, call Sharon at (702) 869-5996; if your case is assigned to Department 2, Judge Tyrrell, call Norma at (702) 455-0733. A court reporter is needed to prepare a transcript should you decide to appeal your case to District Court. There is a fee of $30.00 to retain the court reporter, payable at the time of service directly to the court reporter. This does not include the cost of a transcript. There will be a transcribing fee of $4.10 per page.
An interpreter is not provided in civil cases. It is your responsibility to bring your own interpreter if you are unable to speak English. You may contact the District Court Interpreters office at (702) 671-4578.
It is also your responsibility to bring any witnesses that you want to testify on your behalf to the hearing. The Court will not continue your case if you fail to bring your witness.
AFTER YOU HAVE RECEIVED JUDGMENT IN SMALL CLAIMS COURT
After you have received judgment in Court and the Defendant still has failed to pay you, you may make a request for an execution. To do this, complete an "Instructions to the Constable" form directing the Constable to either attach the Defendant's salary or his/her bank account. You must provide the name and address of the employer or the bank branch, account number, etc. The Court does not and will not obtain this information. The clerk will file the execution for you for a $6.00 filing fee. After the Constable's Office collects their necessary service fees, they will serve the execution upon the Defendant's employer, bank account, etc. Money will be received on your execution by the Constable's Office and they, in turn, will send the money to you. The time frame for execution process is approximately three (3) weeks. If the first execution does not give you payment in full, you must keep filing executions until payment in full has been received. All fees paid by you for filing and serving executions are added to your judgment to be paid by the Defendant. A garnishment on wages will continue for 120 days. Once your claim has been paid in full, you must file a "Satisfaction of Judgment" form with the Court.
