AFTER A SMALL CLAIMS CASE HAS BEEN DECIDED

BOTH PARTIES: 

If unsatisfied with a decision on a case  heard by the Judge the decision may be appealed.  The appeal must be filed within five (5) days of the date of judgment, not counting weekends or holidays.  Plaintiff, in order to appeal, must post bond in the sum of $250.00 and pay a filing fee of $71.00.  The Court Reporter must be contacted to see how much is due for the transcript.  The transcript of the hearing must accompany the appeal to District Court.  Defendant, in order to appeal,  must post bond in the sum of the judgment plus the court costs, and pay a filing fee of $71.00.  The Court Reporter must be contacted to see how much is due for the transcript (in addition to the $30.00 already paid).  The transcript of the hearing must accompany the appeal to District Court. 

DEFENDANT: 

If arrangements have been made for stay of execution based upon installment payments on the judgment, there will be no forced collection as long as the payments are current.  Otherwise,  the Plaintiff has a right to attach wages, file a lien against  property, take a vehicle through a Writ, attach a bank account, etc.  The judgment is enforceable for a period of six years and may be renewed for additional periods.  The case may be appealed as set forth in Paragraph One. 

PLAINTIFF: 

If judgment was received by Default (the Defendant was served but did not appear), or if your case was heard by the Judge and judgment was granted to you, there are several options available.  Wages, salaries, commissions, bonuses, and property may be executed upon. All Executions must be accompanied by a Writ of Garnishment with a payment of $5.00 to the employer, bank, or entity that will be processing the Writ.  If executing upon an automobile, there must be a full description including vehicle identification number (VIN) and where it can be found.  A print-out is needed from the Motor Vehicle Department at the time the Execution is filed.  If  executing on a bank account, the bank account number, bank branch, and address is needed.  The Execution must be filed at  Court offices.  Please be prepared with detailed information on the property to be seized. The clerk will need the case number and, if possible, the social security number of the Defendant. 

Additional fees include,  $6.00 for the Execution plus the Writ filing fee and Constable's fees.  Proceeds of the Execution go to the Constable's office which will make arrangements to turn the money over to the Plaintiff.  The fees paid for filing and serving the Execution are added to the total due from the Defendant. 

The Court does not investigate, collect moneys, or accept payments from judgment debtors, nor does the Court give advise or the measures to take to collect judgment other than as set forth above.  All of  this information must be available before coming to our office to file the paperwork.
