UTILITY FRANCHISE/ R IGHT -OF -WAY LICENSE
APPLICATION PROCESS

STEP 1:    Apply for a Clark County Business License, Pursuant to
                  Clark County Code Title 6.13 At:

                Clark County Business License Department

        Submit the following:

         A.    Business License application, including all backup documentation 
               
(available from Business License Department; staff will assist you
                with this process).

         B.    Copy of the order and Certificate of Public Convenience and necessity
                from the Public Utilities Commission, if required by the laws of the 
                State of Nevada  (apply at PUC, 555 E. Washington Avenue, 
                Ste. 1300, Las Vegas, NV 89101, (702)486-2300).

STEP 2:    Apply for a Franchise or Rights-of-Way License, Pursuant to
                  Clark County Code Chapter 5.01 (copy attached), At:

                         Clark County Administrative Services, Franchise Services Division
                        500 S. Grand Central Parkway, 6th Floor

                        Las Vegas, Nevada 89155-1712

         Submit the following:

         A.    A copy of all Clark County Business Licenses, or proof of approval,
                pertaining to applicant's activity in the rights-of-way, (obtained in Step 1
                above)

         B.    A statement setting forth all agreements and understandings existing
                between the applicant and any person with respect to the applicant's
                acting as an agent or representative of another person regarding use of
                rights-of-way.

        C.    1)    For a corporation, a list of officers and directors of the applicant; or
                2)    For a partnership, a list of all partners and their relative interests 
                       in the partnership.

        D.    A statement of whether any of the persons listed in subsections 2.B and
                2.C has had a franchise or rights-of-way declined, suspended or
                 revoked, and, if so, the government agency issuing this decision, the
                 date, time, place and reasons given.

        E.    A list of persons that will be using the applicant's facilities in rights-of-way
                to provide subscription service of which the applicant is aware at time of
                application.

    F.    The following information, pursuant to Nevada Revised Statutes Chapter 709.

  • name of person making application

  • nature of franchise or rights-of-way license applied for:

  • date of public hearing on the application

  • a statement that anyone having objections to the franchise or rights-of-way license must 
    file their objections in writing with the County Clerk prior to the public hearing date, or 
    must appear at the public hearing to present their objections.


STEP 3:    When an Application Is Certified as Complete by the Director of
                   Administrative Services, the Applicant Will Be Notified and Notice 
                   of the Application Will Be Given to the Public in the Following Manner
                   (Pursuant to Nevada Revised Statutes Section 709.070):

         A.    The Applicant will be required to deposit $200 with the County Clerk
                  to cover the cost of publication of legal notices (County Clerk-Commission
                  Division, 500 S. Grand Central Pkwy., 6th Floor, P.O. Box 551601, 
                  Las Vegas, Nevada 89155-1601).

         B.    The Board of County Commissioners will direct that a notice of 
                 the application be circulated, containing the following information:

  • name of person making application;

  • nature of franchise or rights-of-way license applied for;

  • date of public hearing on the application; 

  • a statement that anyone having objections to the franchise or  rights-of-way license must 
    file their objections in writing with the County clerk prior to the public hearing date, or 
    must appear at the public hearing to present their objections.

        C.    The notice will be published once a week for four consecutive weeks in a
                local newspaper and posted in three public places nearest where the
                application will take effect.

STEP 4:     A Public Hearing will be scheduled immediately following the
                    Four-Week publication; and following the Public Hearing, the
                    Board of County Commissioners may grant or deny the Franchise
                    or Rights-of-way license.
